HI, we have had a mortgage refused due an interim charge appearing on LR search.  I have no idea what this is and the bank are unable to say as the LR search just says there is one.  How do i find out what this is?  I have purchased the Title register and cant see anything other that the existing mortgage (with the same lender as new application) and the ownership being transferred to us with the usual tennants in common clause?  Help as i am stuck between LR and bank :(

Hi Kate - an interim charging order is an order issued by a court with regards a debt against one or more people. The creditor can, in certain circumstances, then protect that debt against a registered property - Practice guide 76: charging orders - GOV.UK 
If the register makes no mention of such an interest/order then I would go back to the bank and ask them to double-check and/or confirm the details they are viewing

Thanks Adam, i have purchased the title register and deeds on line this morning and there is nothing on there regarding a debt?  Should i be able to see a debt exists and secondly who has put a charge on there?  I am very worried that somekind of fraud may be taking place as we have no knowledge of any debt.  Please can you help point me in the right direction to identify what this could be?

Kate - yes, the register would refer. I wouldn't be worried as the bank may simply have the wrong info from somewhere. They'd only be looking at the same registered information as you have so please do go back to them and explain that the register you are looking at for [property] as registered under [title number] makes no mention of an interim charge

Thanks for your speedy reply - ive already gone back to them twice and they are flat out refusing to budge saying the LR says there's an interim charge?  How can i view interim charges, is it possible something is pending that i cant see on the £7 purchase of the docs from the LR website?

Kate - what's the title number please? It may help me if I can look at what you/the bank are both looking at. It may well be that there is something 'pending' as you suggest

Kate - many thanks. There i no reference to an interim charging order on that title register.
The only 'charge' on the register is the one in favour of the named lender and that's a registered legal charge (mortgage/secured loan)
There's nothing 'pending' and nor has there been an official 'search' against that title number 
Have you sent them a copy of what you are looking at?

They arent allowing me to do anything - they refused as they cant see anything other than the interim charge flag and pushed me back to LP to get it removed :(
Time to try a different mortgage lender perhaps and see if they get anything back on their check? Thanks for your help.

Kate - LP? Very odd though but I can't prove a negative sadly and clearly something's awry at their end as nothing wrong with what you and I are both seeing
