Hi there,  myself,  my husband and brother are all jointly named as title holders on the property I live in with my family.
My brother has asked for his name to be removed and myself & husband to remain on the register.
How can I get my brothers name removed.
There is no money exchanging hands for the property,  although we are helping him financially buy another place.   We have a small mortgage on the property we live in,  but that is just in mine & my husband’s name.  Is this something I can do myself with my brother,  or do I need to use a solicitor???  Many thanks for your assistance.

Hi Victoria - see our online guidance on how the three of you can transfer to just the two
Whilst you don;t have to use a conveyancer we usually recommend you do.
And if there's a registered legal charge (mortgage) on the title and dated at the same time or after the three of your were registered then all 3 of you would be on it.
Either way the lender may insist you use a conveyancer before they consent to any such transfer as well

Good Morning ,

which government form do we need to remove our names from a deed that removes me and my wife and leaves just my son . There isn't a mortgage on the property and no money will change hands .

Good Afternoon Derek - if the three of you are registered as owners then to remove two and leave one then you all need to transfer the legal ownership using forms AP1, TR1 and ID1/ID3 as appropriate - Registering land or property with HM Land Registry: Change the registered owner name - GOV.UK

Hi  is it easy to change the name on the land register of deceased person to two beneficiaries who will be tennants in common and may want a restriction if possible so that one can't sell without the others permission.   Thank you

Hi Mary - see our online assisted guidance for how to update the register following the death of an owner - HMLR Guide: Start - External  · HM Land Registry
Such applications can be 'easy' to make but please do seek legal advice as appropriate to consider what's best especially re your Q re selling without the other's permission. If two people are registered as the legal owners then any sale would have to be by both of them.
