Hi<br> <br> I would like to remove a charge which I have on my brothers property for a loan which he has already paid back to me.<br> <br> If I am willing to do this without a conveyancer (which would be my preference) do I simply fill out the DS1 & DS2 forms together with an ID1 (which my solicitor will do for me) and send all these to the land registry at<br> <br> HM Land Registry<br> Citizen Centre<br> PO Box 74<br> Gloucester<br> GL14 9BBs. <br> <br> Do I need to complete an AP1 as well?<br> <br> I want to make sure I take the correct action so the charge is removed swiftly so my brother can take out a mortgage.<br> <br> To make an expedition request would I just enclose a letter explaining the situation or is there a form for this?<br> <br> Thanks

Hi Ed - correct re forms and submission. No AP1 needed if using form DS2 - both are application forms<br> Once submitted you can request expedition separately - <a href="https://www.gov.uk/guidance/request-an-expedite">Request an expedite - GOV.UK</a> <br> Expedition will get the case to the processing start line. After that the casework team will contact you as appropriate

Thanks so much Adam<br> <br> Just to double check; does using a DS2 instead of an Ap1 affect the speed with which it's processed?<br> <br> I'm slightly confused that there are 2 options to achieve the same result and not sure which is best. <br> <br> Thank<br> Ed<br>

Ed - No. Form DS2 is designed specifically and solely for applying to discharge a legal charge. Form AP1 is a generic application form used to apply to update the register in a variety of ways, one of which can be a discharge.<br> There is no 'best' form - they both work in exactly the same way from a processing perspective
