Hello, I was hoping someone from Land Registry would be able to help.

We are near the end of our house sale and purchase of a property. Unfortunately during conveyancing it was discovered that the driveway for the house was never registered on the title with the LR. The sellers cant prove ownership so through their solicitor have applied for adverse possession. The sellers have lived in the property since it was built and have never sold before.

The title is SX19200 which relates to the property, but the driveway to the front of the house is not included within the boundary.

The sellers solictor submitted the claim for adverse possession on 6th September which has apparently been dealt with by the LR. A surveyor from OS should be due soon but I don't know when that is likely to happen. Could you give me an idea?

The chain below us is getting very impatient as it has now been almost 6 months and we havent exchanged yet. Any help you can give to speed this along would be very much appreciated.

Hello Justin - so application received on 9th Sept. Survey letter issued on 19th and generally speaking OS visit and report within 2 weeks. It's often quite quick but all depends on their available resource etc
They then report back and the report gets considered alongside the claim. If all in order the final stage is wider checks are needed which involve contacting adjoining landowners to see if they consent/object. They are usually given 3 weeks ot respond.
So you are still looking at a period of time before matters might be registered. And we won;t know whether that final stage has been reached until the OS stage has completed
Neither the OS survey or wider checks can be fast-tracked/expedited as both are reliant on third parties
