Hello.

I am helping my mum to transfer the title of the home she shared with my late dad, into her name (she still lives there). Only my dad is currently named on the title as registered owner.

Please can you confirm I am following the correct procedure and using the correct forms i.e. we will need to submit the following:

ID1
AP1
AS1

Specifically on AS1, is it acceptable that this form is completed by my mum even though she is both the personal representative AND the person the title is being transferred to? My mum, myself and my brother are all named on the Letters of Administration (my dad did not leave a valid Will).

Hello John - those are the correct forms. Yes, your Mum can be the administrator and beneficiary. Do check the letters of administration to confirm whether all three of you need to transfer the legal ownership

Hello Adam.

Many thanks for confirmation. We are all named on the letters of administration (we were advised when we applied that this was optional and that it may be helpful at some point), but the property is only being transferred into my mum's name, hence it is her name on all of the forms.

Can we send all of the completed forms in together?

Hell John - you all need to complete the transfer (AS1) then and submit everything as a single application, correct

Just to double check...

All of our names need to be on AS1 i.e. all three of us (including my mum) are assenting the property to my mum, and we will all need to sign it?

Only my mum will need to complete ID1 as she is the one who the property is being transferred to? Surely we don't all need to submit ID1 separately?

I'm wondering if we might make it simpler by submitting my dad's death certificate instead of the letters of administration, or will that not be correct procedure?

John - correct re all three transferring but all of you will need to have your identities verified
Submitting just your late Dad's death certificate won't then transfer/change the legal ownership

Sorry, Adam, a quick further question on AP1 - do we just include my mum's name/details on this one i.e. we don't all need to sign it (as we will for AS1)?

And can we all certify just one copy of the letters of administration, or do we need to send three separate copies, with our respective signatures on each?

John - if Mum is the only person applying then she can complete and sign it, correct

Hello again Adam.

I'm stuck on some of the AP1 panels (NB we are completing the form ourselves).

Panel 4

Is the wording to use in the application column 'Assent'?

The property value is £480,000 - will the fee be £100 (under scale 2 i.e. the property is being assented to my mum)?

Panel 14

We need to include all three of our names in the 'name of...' column, and 'none' against all in the second column?

We need to tick BOTH boxes under (2) evidence of identity i.e. we are all providing proof of identity?
