Hi!<br> <br> I live in the upstairs flat of a converted terraced house. My downstairs neighbour and I bought the freehold for the property in 2021.<br> <br> I'm planning a loft conversation, with the full support of my neighbour. Would I require a deed of variation to ensure the title deeds state that I have sole access to the attic? When the property was a leasehold, the attic didn't form part of the demised areas.<br> <br> Thanks!

Hi Ben - I suspect yes as you are in effect varying your lease to include 'more' to the demise. In essence varying the lease to include  more n the demise acts as a <a href="https://www.gov.uk/government/publications/extension-of-leases-checklist-for-submitting-an-application-to-register-the-surrender-and-regrant-of-a-leasehold-estate-pg28s1">surrender and regrant </a>of your old lease to include the variation<br> I'd recommend that you seek legal advice/assistance to draw up the required legal deed and to submit the appropriate application
