Good morning,

I have been approached by a neighbour about purchasing a portion of my garden. We are looking to put the property on the market as soon as we can however so I just wanted clarification as to what the steps would be in regards to transferring a portion of land to someone, how long the estimates are for that type of application?

as the boundary lines will change we would need that to be updated prior to any sale, does that involve a new title registration or is it a quicker amendment? Any insight would be greatly appreciated. Thank you

Hello, another point, I said above that it’s my property for simplicity, however we are still in the process of applying for probate as it was by grandmothers property (sole owner) who has passed away. In order to go ahead with a partial land transfer/sale, would probate need to have been granted already or is being an executor sufficient? The probate application obviously takes quite a long time sometimes so just wanted to clarify if the transfer would have to wait until that point. Thank you

Sophie - you'll need probate before you can do anything else
Once you have probate you can transfer the land - Registering land or property with HM Land Registry: When you must register - GOV.UK
And once the application to transfer the land has been submitted you can request expedition to fast-track the process and keep the wait time to as short as possible - Request an expedite - GOV.UK

Sophie - we don't deal with the selling/buying. But the link re transferring land explains what we require once the sale/purchase has completed

Sorry, can I just confirm then that it would be a tp1 form we would need to complete once the land is sold, and that would have to be completed by the person with the grant of probate? Thank you

Sophie - if the land is owned by a single person, who has now died, then you will need probate first to enable the executor to then sell part of the land. To transfer ownership a form TP1 will be needed, correct
