Hi, I have an equitable charge against my property from 2010. It was made in favour of MBNA and shows on the registry. I contacted MBNA and due to the age of the debt, they couldn't find any record of it and eventually informed me they thought it was sold off to Lowells. Lowells have no record of it either! They are certain it wasn't passed to them. MBNA still can't tell me anything else about it, so my question is; how do I go about removing the charge please? I am selling the house and trying to get a new mortgage but the lender needs to know the charge will be resolved upon sale of my house. All I have from the Registry is the date, court reference, and name of the creditor (MBNA). It doesn't show how much the charge even is! Can anyone help me please? 😊

Hi Daniel - form CN1 can be used to apply to cancel an equitable charge. However you will need to provide supporting evidence to show it has been paid off/redeemed.<br> If you don't have that then you may have to return to court to have it dismissed and rely on that dismissal as your supporting evidence<br> The only details we will have will be the original order for example detailing the amount owed at that time. <br> <a href="https://www.gov.uk/government/publications/notice-cancellation-cn1">Notice: cancellation (CN1) - GOV.UK</a>
