To merge or not to merge

To merge or not to merge. Does the following still apply or has it been superseded ?
If the lease is merged into the freehold any easements on the lease can be carried forward to the freehold thanks to Wall v Collins 2007. The LR pg 26 para 2.1.2 last bullet says they are normally carried forward. Will this be done automatically by the LR or would I have to apply in addition to the application to merge the titles ? Would an entry be added to the charges register of the freehold title?

Philip - you would need to make the request to note the easements on the freehold reversion as part of your application to merge and determine the lease. If you din;t do that then you can apply afterwards/later by way of form AP1 to do so.
