Hello.

I am purchasing a house and my solicitor has requested via the sellers solicitor corrections to the title around the premises name and general errors to the title, my solicitor is very competent but the sellers solicitor hasn't spoken to us for a week and I would like to know is there is application for these changes with you. Can you help? Thanks Dean

Neil - many thanks. We had an application to amend the property description/address. Submitted 26th Feb and completed 3rd March. So am guessing what they wanted amended has now been done and they are aware

Dean - there is a right of way over blue land referred to. But nothing re that was part of their application

Hi again, are you able to check again and see if any new applications have been made in relation to the right of way and blue land. below is what my solicitor and their solicitor have said  

27.02.25 – Thank you. Please submit this to the Land
Registry so it can be noted against the title, and let
us have up to date office copy entries once this has
been completed. Please ask the Land Registry to
expedite this.

10.03.25 - We have made contact with HM Land
Registry and await hearing from them.

Dean - no problem. I'm sure they are going to do as you have been told but sometimes it takes longer than you might hope for that to happen.
Let's check again for an update later in week as you suggest

Hi again, I would appear that according to the title plan, there are two triangles of land that do not belong to the property one of which is between the road and the entrance to the driveway, our lender is unwilling to continue unless we can show "enduring and unimpeded right of access over this land" - my solicitor is asking our sellers solicitor to

"Please apply for prescriptive right over the land shaded in
blue or you can apply for adverse possession."

What's the timescale on the sort of matter, clearly we have a mortgage offer that will expire and want to use the swiftest method possible to satisfy the mortgage company.

Any advice appreciated. Thanks

also if you could check if any further application have been made since Monday please.

Dean - we had a request to amend the title but we needed more from the conveyancer before we could do that. They've since replied.
The casework team have just completed the amendment and updated the registered information. The conveyancer will be notified
If you need an explanation as to what was requested and why then I'd suggest speaking to your conveyancer/seller as appropriate

Thanks Adam. There appears to be another issue as there is a piece of unregistered land in between the road and the boundary of the property that effectively will prevent us accessing our drive way and our lenders won't proceed until this is resolved.

We have requested the sellers conveyancers apply for Prescriptive Right of access or Adverse possession but now we have a looming mortgage offer expiry so time is of the essence.

What time frames are we looking at for these options to be done, the current owners have been crossing the land ( about of 2 feet) for over 40 years.

Dean - both will take time to complete as in both cases it's likely that a site visit/survey will be required and/or wider checks made with neighbouring landowners for example
They will need to request expedition to ensure the wait/processing time is kept as short as possible 
Both processes are explained in our PGs on the subjects
Adverse possession of (1) unregistered land and (2) registered land where a right to be registered was acquired before 13 October 2003 (PG5) - GOV.UK and
Easements claimed by prescription (PG52) - GOV.UK
