Administrators and executing TR1

Hello Letters of Administration have 3 named Administrators. One of the Administrators has lost capacity. The other 2 Administrators on the Letters of Administration still have capacity and can act. Can the 2 remaining Administrators sign a TR1 for the sale of a property? Or can the attorney under an LPA for the administrator sign on their behalf instead? If not - what is the process for accepting a TR1 from the remaining 2 administrators?

Hello Alex - the first port of call will be the letters of administration and what they allow for. Some may allow them to act jointly and severally for example and in turn that allows two to administer the estate instead of all three. If not then you'll need to seek legal advice as to what powers an attorney might have in such cases as the law will make distinctions between an LPA and Trustee power for example. We won't offer a view until an actual application, along with supporting evidence, is submitted
