Our client owns a property, which was converted from a single dwelling into two flats 10 years ago.  He has a mortgage on the building as a whole.  Each flat has a separate council tax banding and a separate Royal Mail address.

He wants to split the title, so that each flat has its own title, with the mortgage secured over both.

Peter Claridge owns a property in Calne. 10 years ago it was converted into two flats 17 and 17a. He has a mortgage on the building as a whole. Each flat has a separate council tax banding and also a separate Royal Mail address.


He wants to split the title, so that 17 has one title and 17a has another title and I would imagine that the mortgage will have to be secured over both of them too.

Are you able to please confirm if this can be handled by retaining the current title number for one flat, and completing a TP1 to gain a new title for the other?  The TP1 would be transferring the property from the client, to the client so the same name.

Andrea - We cannot give any confirmation before having sight of the application and the reasons.  I would refer you to Supplement 5 of our Practice Guide 40, particularly section 13, in the first instance.
