I just wanted some clarification regarding Form A Restrictions. When we are doing a 2-2 Transfer where one proprietor is staying on the title, one is being removed and a new one is being put on, and there is an existing Form A restriction on title, but the existing and new proprietor are holding the property as tenants in common, am I right in thinking that the Land Registry doesn't require an RX3 for the removal of the sole proprietor restriction, as the current one will be held on title? If so, will the Land Registry just take what is mentioned on the Transfer as their evidence should this ever be raised?

Hopefully that makes sense, please let me know if you need an example!

G A Mark - if you are registering a Transfer and no monies are changing hands then the form A restriction should be left on the register whether they the new ones are holding as TIC or not.
Without an RX3 and suitable supporting evidence to the contrary the form A will remain
