Good morning

Title Number: CYM2165

Would you be able to tell me what Entry Number 2 on the charges register of the above title, is regarding?

Is it a transfer in relation to the leasehold land to Mr and Mrs Hall (Possible Home owners)

We are unable to find any existing lease and trying to assertain that the lease is no longer valid.

The title is Freehold Absolute indicating that a lease no longer exists

Kind regards

Jason

Good morning Jason - entry 2 relates to a Transfer and reservation of drainage rights so is that the correct title number?

Hi Adam

Thank you for the swift reply.

Yes the title is correct. Was it the retention of the drainage rights after transfer of the lease ?

Entry 1 mentions the lease and the dates of both entries are the same. We think that the (Halls) bought the lease from the university at this time but the university retained drainage rights.

We dont think a lease still exists and that the Halls were the property owners that bought out the lease as the title is now showing freehold absolute.

The adjoining house next door is Leasehold and gives details of its lease.

Hi Jason - many thanks
The entries are dated the same as that was when the property was first registered. That application will have included details of the 1916 Lease and the 2000 Transfer was the deed that triggered the need to register for the first time
We wouldn't know what the 'thinking' was behind the 2000 transaction
The fact that the freehold is registered with a noted lease does not mean that the lease has come to an end, been determined or bought out.
If they did buy the freehold and already owned the lease then the latter would only come to an end if they requested merger for example. Practice guide 26: leases – determination - GOV.UK
I'd suggest seeking legal advice
