Hey there,&#160;&#160;<br> <br> My partner and I bought a property 8 years ago. At the time, the property was only in my partners name,&#160; so when purchasing the house, we registered a restriction to protect each of our interests.<br> <br> We have since then got married and now have a joint mortgage offer.&#160; In order to proceed however,&#160; we need the restriction removed given we will be equal joint owners.&#160; Our solicitor at the time told us,&#160; once we were married the restriction would no longer be applicable.&#160;<br> <br> Given this,&#160; with the RX3 form, would&#160; our marriage certificate alongside a joint statement of truth be sufficient to cancel the restriction.&#160;&#160;<br> <br> In addition, how long does it take for such a cancellation request to be processed? Any advice would be greatly appreciated.&#160;&#160;

Hey Antony - if the restriction is a form A/joint ownership restriction then form RX3 and ST5 can be used to cancel it&#160;<br> <a href="https://www.gov.uk/joint-property-ownership/change-from-tenants-in-common-to-joint-tenants">Joint property ownership: Change from tenants in common to joint tenants - GOV.UK</a>&#160;<br> If your partner has changed name due to marriage then a form AP1 plus a certified copy of the marriage certificate should also be submitted -&#160;<a href="https://www.gov.uk/registering-land-or-property-with-land-registry/update-or-correct-the-register">Registering land or property with HM Land Registry: Update or correct the register - GOV.UK</a>&#160;<br> No fee for either application
