Hey there,  

My partner and I bought a property 8 years ago. At the time, the property was only in my partners name,  so when purchasing the house, we registered a restriction to protect each of our interests.

We have since then got married and now have a joint mortgage offer.  In order to proceed however,  we need the restriction removed given we will be equal joint owners.  Our solicitor at the time told us,  once we were married the restriction would no longer be applicable. 

Given this,  with the RX3 form, would  our marriage certificate alongside a joint statement of truth be sufficient to cancel the restriction.  

In addition, how long does it take for such a cancellation request to be processed? Any advice would be greatly appreciated.

Hey Antony - if the restriction is a form A/joint ownership restriction then form RX3 and ST5 can be used to cancel it 
Joint property ownership: Change from tenants in common to joint tenants - GOV.UK 
If your partner has changed name due to marriage then a form AP1 plus a certified copy of the marriage certificate should also be submitted - Registering land or property with HM Land Registry: Update or correct the register - GOV.UK 
No fee for either application
