Good morning. We have been awaiting completion of an adverse possession application which i have been advised many times from our conveyancer has been expedited and was initially applied for in April this year This is now urgently holding up completion of our sale and as yet nothing has been resolved and we arent getting any further updates from our solicitors at all, apart from we just have to wait! This is so frustrating as i am sure you can appreciate as the sale has been going through since March. A valuation was carried out by yourselves and completed in August and we still havent heard anything further. We are at risk of the buyer loosing patience and us loosing this sale and in this economic climate we cant let this happen and hence i really need to understand where this application is please as its now very very urgent! we are waiting for this before we can complete.  I feel i am getting fobbed off by our solicitors and really need some answers and understanding where we are with this please. Any update most appreciated as this is now causing considerable distress not knowing how much longer this is going to take. The title ref in question that the adverse possession applies too is yea56719 OS ref: ta1464ne. I hope this helps. The adverse possession application that has been made by our solicitors is under ref 11/f54wpnb. Good Afternoon Alison - the application was submitted on 30th June. It was expedited 1st July and processing started 3rd July. More was needed from the conveyancer and a survey was also requested. 
It looks like there was a delay in getting the survey completed but that was done in early September and the conveyancer's final reply was on the 5th
It's currently with our lawyers for them to decide whether wider checks are required. I'll check with the support team to see if they can offer more of an update

Hi Adam that is great thank you very much for the update. Apologies for the duplicate post on here! If you can offer me any further update after you have spoken with your support team i would be so very grateful indeed. We really need to get this across the line so any help you can offer in respect of this would be most appreciated indeed! I will await to hear from you and thank you for the application details. I hadnt been passed this from the Solicitor so was trying to work out what would be needed to chase with you. Thanks again

Hi Adam, thanks again for your help on this, your help is really much appreciated as its so urgent now we get this sale made. The buyer is wanting to walk away now so anything that can be done to try and get this across the line is most appreciated,  as its beyond urgent now!

I know you mentioned it might need a 2nd investigation , wider checks but just in case it helps, I dont think this case could be any clearer here.  The missing land is such a thin weird shape you can see its just a historic mistake somehow in how its drawn.  It doesn't appear in its shape to have any sense other than some very old mistake.   The shape just ( to me ) is so thin and irregular it would be impossible to think anyone could possible want or try to claim it?   The land is entirely fence in by 6ft steel fencing, which has been there since we bought in in 2009 but most likely before that at least 20-30 years.  Then the land is through the middle of our buildings....so its not a little bit of land on the edge anyone else could claim. Its physically UNDER and THROUGH our buildings!.  Those buildings have been there since the 1970s so there can be 0% doubt this land should be registered to us.   I know there is process to follow but if anyone could look at this, hopefully we can see its 100% clearly ours and there is no other possible stakeholders here.    The over compelling fact is that the land to the east of the site is BW industries who are buying the land.  The land to the south and west is Marblechip who SOLD us the land, and have already acknowledged the land the boundary. ( in fact we submitted the sales particulars from them when they sold us it which also shows all the footprint/site plan so its 100% clear ).  The only other neighbour is farmland at the back which is clearly not connected in anyway to this unit.  So there is no neighbours or anyone else who could possibly contest this.

If you can chase this I would really appreciate it as we need the money urgently but also the buyer is talking really talking about cancelling the sale now so every day is going to count here!

Hi Alison - all noted and appreciated but wider checks are now underway and they don't expire until after the 13th November unless the recipient responds sooner

Hi Adam, are you able to help/ provide any further updates re the application now that the wider check date has passed its expiry? Just keen to understand next steps and hopefully get this matter closed and resolved asap so that I can pass onto the conveyancer as all sides are keen to pass to a completion date asap.
