I am an executor and beneficiary of a will. The estate is a property which will be sold once probate is complete.
I would prefer to keep the property registered in the estate name, rather than my own - can I do this?
When the property is sold, I will inherit the sale proceeds.

Jane - most buyers are happy to rely on the current register and a copy of the probate on which they can complete

So is it legal to do it this way so that CGT is not payable?

Jane - we don't deal with CGT, that would be HMRC. It is perfectly legal for an executor to sell a property and then distribute the proceeds of sale as appropriate. The issue of legality arises re how you distribute the monies and/or what taxes might be payable
