Hi<br> <br> My wife and I have agreed to separate very amicably. We also have a son and our own futures to take into consideration. I appreciate that a solicitor should be used for peace of mind but&#160;I got a quote from a solicitor which came to just over £1000 and another one charged £700, and both seem a little steep. On both quotes, there were searches fees which seems unnecessary, VAT and also the solicitor's own fee which nearly came to £1000 alone,<br> <br> My wife and I have agreed that the best option would be for me (as the husband) to take full ownership of the house and I have put in for a mortgage which has been accepted in principle and just awaiting the final approval. This mortgage finance obtained will be used to give to my wife in order to buy her out of the house. Matthew - The procedure for removing someone from ownership of land and property involves the whole of the title being transferred by the all those who are currently named as legal owners to those who are applying to be the named as the owner(s).

It is important to stress that we can only assist with guidance on our requirements, such as the forms required to be completed.  We cannot help with any guidance on what you should do or say on the forms.  If you wish to proceed with doing your own conveyance in the circumstance that you have explained then you should carefully consider the legal and other implications of your actions.  That is where independent legal advice comes in.

You also refer to taking a mortgage.  It may be worth checking with the lender if they would be willing to proceed based on you doing your own conveyance.  Most of the lenders will insist on use of a legal conveyancer.
