Hi. We have a restrictive covenant on our property as our boundary abuts National Rail (NR) property. The title register (DN449789) includes an extract from a 1970 conveyance which includes a standard restriction to not build anything within 10 feet of the NR boundary. There is a private dead-end path between our garden and the NR boundary but the path forms part of our property and NR and our neighbours have right of access over it. Our current garden fence is well outside the 10 foot boundary with some of our garden "outside" it but it is life expired so we have raised a speculative query with NR to see if they will permit us to erect a fence bordering the path but within the 10 foot limit so we can have all of our garden inside the fence line. The NR surveyor has asked to see a copy of the original 1970 conveyance but we have no copy of it, and it wasn't part of the paperwork of our conveyance. The 1970 conveyance predates our property which was only built around 2003. Is there any way of tracing a copy of this old conveyance, or is it likely now lost to time?

Hi Michael - we don't keep copies and I would imagine it's 'lost' in the way you suggest. Historically when we registered a title, and set out an extract from the named deed, we would not retain copies. The purpose of a land register is to provide the relevant detail in that format and not be a repository for old deeds for example.
The deeds will have been returned to the conveyancer at the time of first registration (1996) and may or may not be passed on to each new owner/buyer
