Splitting the title - registered owner?
Splitting the title - registered owner?

Hi,
I have just completed on the purchase of a property with two buildings on it. It's my intention to split the property. I also want to submit a claim to register the driveway as part of the property, as this has accidentally not been included in the first registration.
Do I need to be the registered owner for this?
I am conscious that I am unable to get a mortgage until this is done so it is a priority. My solicitors are still awaiting on completion paperwork from sellers, and they have been woefully slow so far, so I don't want to have to wait for them to get their act together!
Thanks.

Hi Meg - any claim will be based on the 'facts' provided to confirm your legal ownership. Whilst clearly any adjoining title information will have some impact such a claim is not reliant on you owning adjoining land
Do rely on your legal advice here as to what legal proof of ownership of the land exists and how best to apply to register same

Apologies I possibly poorly worded my question. I have bought the land and now wish to split the title, however I am not yet the registered owner as the paperwork has not been processed. Am I able to make an application whilst this paperwork is being processed by yourselves or do I need to wait until that is completed before I can make any applications to change the title?

Meg - no apology needed as these things can be tricky to explain sometimes.
You don't have to wait as the application to register your purchase will be with us and have 'priority'. You can then submit a second application as you wish as it will be considered after the first one
