buyer of property - seller has delayed again stating issues with land registry documents

Hi,<br> <br> I'm currently in the process of purchasing a free hold house and solicitors are un-responsive in update me it's now into the 4th month.<br> <br> the seller's solicitor was delayed issuing draft contract because the seller (sole executor) only provided the grant of probate to sell his parents home 3 weeks ago, which he sent to his solicitor along with death certificate,<br> now his solicitor's are saying they still can't issue a draft contract because the house deeds are in the sellers parents name and not his and the issue now lies with the land registry?<br> would this be correct or would the solicitor have enough documents with the probate and death certificate to isse the draft contract?<br> <br> kind regards<br> Gareth

Hi Gareth - we are not directly involved in what's required pre-contract so can't advise on how that works or what the conveyancers require<br> From a purely registration perspective if the property is registered in their joint names then we would need death certificate for the first parent and probate for the second. The executor could then sell.<br> I wonder if perhaps the son is the beneficiary and not the executor?
