We are married couple and would like to transfer our jointly owned property into one of our names. The property is rented out and has the scam protection restriction on it. How do we remove the restriction, then transfer it into one name and reapply the protection restriction again? What forms do we need. I understand we have to prove identity too. Will that require a solicitor? Is there any part we can do ourselves without a solicitor? Thank you for your help.

Sally - you don't have to remove the restriction and then reapply it. You simply need to comply with it when transferring the title from joint to a sole name. The restriction will remain on the register https://www.gov.uk/registering-land-or-property-with-land-registry/transfer-ownership-of-your-property

You will need a conveyancer to assist you re complying with the restriction. You don't have to use one to prepare and submit the application itself but we would always recommend that you do so
