My mother, sister and I are tenants in common (in the ratio 2/3 : 1/6 : 1/6 respectively). My mother has now died and in accordance with her will my sister and I will become tenants in common (1/2 each). There are no other complications on the property, which is registered. Should we submit form AS1 or TR1 (together with AP1 and IDs). Which fee scale is applicable?

Andrew - I am sorry to read of your loss.
We register the legal ownership so there is no transfer/assent in these circumstances. 
The 'shares' and TIC you refer to relate to your beneficial ownerships and we don't record the specific shares on the title. The 'change' in share size is private to you and your sister for example.

The only application to consider would be to update the register re the death

To remove a deceased joint owner from the property record, please complete:

  • certified copy of the death certificate
  • certified letter of administration or probate

Please do not send originals. All certified copy deeds and documents that are lodged with an application will be destroyed following our scanning process and no copy documentation will be returned on completion of the application.
