Hi,

Please can you advise me of what form to fill in when one parter of a tenant in common agreement dies, in order to change/inform land registry?

Is it just form DJP and what accompanying evidence do you need with it please?

Also, we have reference to then nominating persons to be joint trustees alongside the remaining tenant (my mother). Do you know how to go about doing this?

Yours sincerely,

Phil Cooper

Hi Phil - it's legal advice you need here with regards what options are available and what's 'best' in the circumstances.
Form DJP plus death certificate updates the register re the death only
If the register refers to a form A/joint ownership restriction re the TIC you refer to, and the surviving joint owner is the sole legal and beneficial owner, then forms RX3/ST5 can be used to apply to cancel that restriction
This is explained in PG 6 - Devolution on the death of a registered proprietor (PG6) - GOV.UK
However if the legal ownership is to be transferred by the sole surviving owner to themselves and someone else then our online assisted guidance will help identify the guidance and forms needed to update the register - HMLR Guide: Start - External  · HM Land Registry
