Parking space title not transferred
Parking space title not transferred

We purchased our house 10 years ago, which was marketed as having a parking space and where the seller had declared on the TA6 that the parking space was being sold with the house. We are now in the process of selling our property and have found that the title for the house is in our name but the parking space title is still in the old seller's name. She has since moved abroad and we cannot contact her so what can we do next to resolve this?

Rhonda - you will either need to locate her and have her transfer the parking space to you OR consider claiming the parking space as your own. I would strongly recommend pursuing the matter with your original conveyancer as you presumably had a contract that included both property and parking space as part of the sale/purchase. Or identify a new conveyancer to act for you and locate the named owner to contact her and to complete the legal transfer of ownership

Thank you, Adam - we have tried without success to contact the original seller via social media but she is unresponsive despite reading the message from us. We have now contacted our original conveyancer to ask for his help to rectify this so hoping he will help.

Rhonda - that is such a shame on the original owner's part. The key, in my experience as sadly this can and does happen, will be the contract and the seller/conveyancer's legal obligations. And then, if that included the parking space, following that through. How hard that is will depend on the conveyancer, seller and any advice the latter gets but if they are obliged to legally sort then making that as easy as possible for them may help. I wish you well in your efforts
