Transfer Part of Title without Freeholders Consent

I am aware of the TP1 form relating to transferring part of a title to another person. My situation is a little more complex. The Freeholder of the land my flat is on is my local council, I have a lease for several decades and I pay ground rent to them. Can I transfer part of my title to my neighbour who lives below me? The Title forms part of the garden which I cannot maintain any longer. On the form it asks the question about consent from the landlord. Do I have to at the very least notify them of my intention to split part of my title or do they need to consent to it. I would appreciate any guidance with my questions. kind regards, Steve

Steve - Whether you can transfer part of the land leased to you to someone else or not would depend on the terms of your lease. You need to seek legal advice either from a solicitor or Citizens Advice.
We cannot give you any guidance on that as it would be seen as going beyond our remit.

Steve - I would expect that you would have to notify the freeholder before making any changes to what is set out in the lease, including the extent of land being leased. Also, what the Council can do or cannot do is not something we can tell you. We are only a recording agency who registers ownership of land and property.
You need to seek legal advice as I mentioned before.
