I am wanting to register a property by way of voluntary registration so that it can go into auction to be sold. There are three executors named on the Grant of Probate with power served to another executor. Can the property be registered in the executors' names in their capacity as personal representatives of the deceased owner? Also, do all three executors named on the Grant of Probate have to be named on the title or can it be limited to one or two executors?

Dawn - you can apply to voluntarily register it in the name of the executors and in that role for example. You must make it clear in the application that is what you are applying for. The probate will make it clear as to whether the named executors must all act together or not.
