My daughter held property but was killed and I got probate. She left no will so it goes to my daughter who was 10 months old at the time. <br> <br> Who actually holds title to the property at present? Is it my grand daughter, now 11 or my son and I who believe ourselves to be trustees for my grand daughter?<br> <br> The reason I ask is that if my grand daughter holds title house insurance is cheaper as she, the title holder, lives in the house. If I hold title for her insurance is at least £300 extra a year as the title holder does not live in the house.<br> <br> Have you any ideas please?

Colin - the property will remain part of your late daughter's estate until such time as the legal ownership is transferred.<br> Probate provides the executor with the legal authority to deal with the land which would include transferring the legal ownership as appropriate<br> Anyone under 18 cannot be a legal owner and I would be surprised if insurance was available to a minor on that basis as well<br> If you need to understand how the law views the will/probate or trust created then please seek legal advice<br> If the Q is about insurance I would recommend speaking to an insurance broker or insurer directly
