Good afternoon.

We are in the last stage of selling our house and buying a new one. There are 9 people in this chain. During this process it was brought to our attention that our front garden boundary line was incorrect on the original plan. We live in a new development. The Lawyer for the development fixed the plan and it was then sent to our solicitor who then submitted it to the Land Registry office on Oct. 19th 2024. She requested it to be expedited.

The issue concerns the boundary of our front garden. Just a small area that was marked incorrectly on the original plan. It has now been corrected.


We are trying to get this sorted out as soon as possible as there are 9 people in this house sale chain and if we don't get the Deed of Variation back by November 15th 2024 everything will fall through as one of the parties involved only has their mortgage guaranteed up until that date.

We have called the Land Registry many times only to be told that they will mark it as urgent. Can you please take a look and let us know where we are at with this? There are so many people involved and I am sure you can understand the stress we are all under. I called this morning but the gentleman did not send a confirmation email to me like they have done previously.

Good Afternoon Sylvia - I am sorry to read of the issues you are facing 
I can see you have been in touch with our Support team and the matter has been escalated as you mention and as advised.
The application, as it is in effect seeking to rectify the registered information. needs to be considered by a senior officer. Such rectifications can appear simple on paper (plans) but the effect can be much more complex especially if then having a knock-on effect with adjoining/other registered titles.
I'll make enquiries of support team colleagues to confirm the escalation and will post again when I have something concrete to share

Good morning Adam,
Apologies for messaging again but after another day of extreme stress, not just for me but for the other 9 people in the chain, we would like to know if anything can be done to get this completed sooner. Is there anyone our solicitor can talk to directly to get any information from? We only have a few days or everything fails. 
We need to arrange for all the new services but without a date it is very difficult. If we book them now and the Land Registry has not completed our file it will be a nightmare cancelling all the services etc.
Our request was expedited and we keep being told it will be flagged as urgent but it has been two weeks now and we are getting no new updates from our case manager.
We are begging you to please help us.

Good Morning Sylvia - the application was dealt with this morning and a letter issued to the applicant, Title Transfer Property Lawyers. Unfortunately the application cannot proceed and has been cancelled. The reason why has been explained in the letter but essentially boils down to a deed of variation is not a valid means of altering something already registered. The land in question must be legally transferred 
I would suggest contacting TTPL to confirm and to clarify what's now required. 
I'm also sorry that it's not the outcome you will have been hoping for
