With reference to title number DU348751 the burden of the right of way granted by the Transfer dated 22 November 2005 appears to be noted at A3 with the words ‘...but is subject to the rights granted by..’ The burden isn’t noted in the Charges register.  Is the right of way Legal and would a purchaser of the property be bound by it, despite it not being mentioned in the Charges register?

Andrew - we can't advise you on the law. But easements (rights) can be noted in this way as a single entry referring to both the beneficial and subjective rights. It certainly doesn't have to be mentioned in the Charges Register to be binding
