Hi, We are looking to buy a property and the searches showed that it has some restrictive covenants dated 2 June 1927 but the Conveyance is missing for same. Also, the Title Register has mentioned "NOTE: No copy of the Conveyance plan was supplied on first registration." so there is no Conveyance dated 2 June 1927 with details of the covenants. The conveyance for 2013 transfer and then another transfer in 2018 is present. What should we do in this case? Your guidance would be greatly appreciated.

Hi Molly - firstly speak to your conveyancer/legal rep
If the actual conveyance is missing and it can't be found, then the normal route taken is for an indemnity policy to be taken out to insure against the risk of it being found and then containing something detrimental to what you are doing such as a breach of the covenants

Thanks Adam for your reply. So does the seller has to provide us with the indemnity policy for the missing conveyance or this is something which we would have to take on our own? And also, does the insured value in the policy need to be up to the house value?

Molly - that's all part of the buying/selling/conveyancing process/negotiations. We don't deal with such policies ourselves so very much something to discuss with your conveyancer

Hi Adam,

We have now got the proposed Restrictive Covenant Insurance policy from the sellers but I just wanted to confirm that is the right type of policy required in case of missing Conveyance Plan?

Following was the statement given by our solicitor to the seller's solicitors.
Please supply a suitable indemnity policy for the missing conveyance dated 1927 as there are no documents or plans that can be referred to.

Regards,
Molly

Hi Molly - I have responded to your further post in the absence of my colleague.

As my colleague had indicated earlier, we are not involved in such matters and so it would not be appropriate for us to say if what you have is the right type of policy. You should discuss and rely on the guidance from your legal advisor.
