Error In Property Register

Hi, I'm close exchange on the sale of property HD637529 which is just awaiting the correction of an error that HMLR has made to the title. The last sale fell through because HMLR lost the registered copy of the lease and I'm keen to get this one over the line ASAP as the buyer is complaining about the delay. Are you able to check the request to fix the register and see if/when this has been done? Many Thanks

Hi Adam, I believe the amendment on 16th Feb was when the error was introduced but still hasn't been removed. Are there no outstanding requests regarding that title?

Hi Oliver - noted and appreciated although the 'error' was amended on 16th Feb. Appears the conveyancer has raised a later concern on 3rd March and that is with the support team to consider and respond to. That will happen asap HD637529

Hi Adam, has there been any movement on this? We're all desperate to exchange and I'm even more anxious about this owing to the fact the last sale fell through because Land Registry lost their copy of the lease and took so long to find it. I don't want another sale to fail because of a land registry error.

Hi Adam, I've just heard from the buyers solicitor that whatever was asked to be removed, hasn't been. I'm not 100% sure but my guess is the issue is it's the following. (15.12.2025) The title to the lease is, during the subsistence of the charge dated 24 May 2007 in favour of M&G Trustee Company Limited affecting the landlord's title (and, to the extent permitted by law, any charge replacing or varying this charge or any further charge in respect of all or part of the sum secured by this charge), subject to any rights that may have arisen by reason of the absence of chargee's consent, unless the lease is authorised by section 99 of the Law of Property Act 1925. Do you know why this was added and the reason given for not removing it? I have copies of the title register from 2024 and 2025 that don't have this on them so a charge from 2007 is clearly an error.

Hi Oliver - there was no error and that's been explained to the conveyancer. The same issue existed re the 'old' lease which has been varied to create the new leasehold title HD637529 Please do speak to your conveyancer to clarify

Hi Adam, Quick update. I've think I've got to the bottom of the issue. Apparently the error is that the land registry didn't register the "Original Consent to Dealing" which is why the charge is now appearing on the title register. This has been resubmitted this morning. Could you check it has been received and that the request has been expedited? Many Thanks
