Hello<br> We were due to exchange this week and our solicitor has just notified us of an issue - the original house builder went into liquidation and the transfer of the freehold land to the new developer (who we’re buying from) is not complete. Apparently the request has been made but without it, we’ve been advised not to proceed, as it could mean problems completing the register in our names.<br> <br> is it possible to check the status of the registration request from the developer and to get an idea of when it might be complete ? <br> <br> The current developer is Applethwaite Homes, the development is ‘Hillside’ and its plot 3. The original developer was Hollins Homes and the development under them was known as ‘Foothills’. The postcode is BB4 8XP.<br> <br> thank you .

<p>Hello Sarah - The application to register the current developer is held up due to prior applications on the title.</p> <p>The statutes that govern us require that we process applications in the priority order that they are submitted to us. This is to ensure that any rights granted on a prior application are then reflected against the subsequent applications.  The earliest application is being processed but there are queries on it that need to be resolved by the conveyancers who submitted it.  As we are dependent on the queries being resolved by a third-party I cannot give you any specific timescale on when it would be done.</p> <p>Of course, we have approved to expedite the application to change the ownership to current developer which means we will try our best to hasten the things.</p> <p>I hope this is of some help.</p> <p>LAN209955</p>

Hi Nimish, thanks so much for the speedy response!<br> <br> I’m sure you come across this all the time but our ability to proceed with the purchase depends on this and as we’re moving out of area there is so much riding on it, such as school and nursery places. We’re trying to understand if there’s a quick resolution or whether it’s something that will take months (And therefore mean we need a plan B).<br> <br> Please can I just clarify that I’ve understood correctly - so currently an application is being processed but that isn’t the application from Applethwaite, it’s an earlier one. And that has to be complete before the application from Applethwaite can even begin to be processed?<br> <br> - you mention ‘prior applications’ - are you able to confirm if this is just one, or whether there are several? I.e. are we just waiting for one previous application to be resolved and then the next one would be the one from Applethwaite? <br> <br> - is there an expiry date on the current/first application - I.e. if the conveyancers don’t respond to the queries is there a point in time when that application will be void and the more recent application will be processed? <br> <br> Appreciate you’re unable to give specific timeframes but just trying to get an idea! Hi Sarah - The application that is currently holding up the transfer to Applethwaite is a transfer of another plot. We have chased the conveyancers who submitted it and my colleague overseeing the application has agreed to contact them again to see if we can have a quick response. <br> <br> With regards to the time given to respond, this is explained in section 2 of our <a href="https://www.gov.uk/government/publications/requisition-and-cancellation-procedures">Practice Guide 50</a>.   <br> <br> There are 3 other applications before the transfer to Applethwaite, but I do not think they would be much of an issue. <br> <br> However, during the conversation with my colleague it became evident that we do have subsequent applications (after the transfer to Applethwaite) for transfer of other plots by Applethwaite.  There is nothing to prevent an application for your purchase to be submitted, but that is for you and your solicitors to decide.  What your solicitors currently cannot get is an Official Copy of the title register showing Applethwaite Limited as the registered proprietor of LAN209955. <p>I am not sure if the above helps. </p>
