Hello,&#160;<br> <br> Ref: Title number:&#160;AGL300161<br> <br> I purchased my flat with a new lease of 95 years from date of completion in 2014. This was confirmed in the contract report of title prepared by my solicitor. I signed and return this contract report.<br> <br> Land Registry does not show the new lease and it shows I inherited a lease that in 2014 was already just 78 years. I only discovered this recently.&#160;<br> <br> My solicitor does not remember anything about it and is not being at all helpful.&#160;<br> <br> How can I correct this on the Land Registry? What should the solicitor have done that they clearly have not done.&#160;<br> <br> Thank you so much,&#160;<br> &#160;

Hi Jennie - if the lease was extended then an application needs to be made to register that. Many landlords/tenants enter into a deed of variation to extend the lease&#160;<br> I'd suggest you contact the solicitor to query/escalate matters. A solicitor will need to apply as the property is mortgaged and the lender most likely won't let you do it yourself<br> AGL300161

Jennie - there was an application submitted at the time but it was rejected as it contained&#160; a number of errors. The application was submitted by&#160;VICARAGE COURT SOLICITORS LTD who were acting for you I believe as they later resubmitted the application to register your purchase but with any details of the lease extension/new lease included&#160;<br> You may want to try contacting them and escalate matters with the firm and/or the freeholder/landlord - the latter may well have a record&#160;<br> AGL300161

So any additional context will be helpful to them to try and shed some light. Jennie - there were but nothing that would assist in addition to what you already know and have heard from VC direct<br> The key is finding the new lease/deed of variation and if that can't be found then the way forward is drawing up a new deed and going from there as if it was being extended now&#160;<br> 10 years is a long time and unless the landlord kept their version/copy then trying to find something now is likely to be a fruitless task in my experience&#160;<br> AGL300161

Its incredibly kind of you to put this much&#160;effort in to checking the records for me.&#160;</p> <p>What this does do is prove the&#160;intention was&#160;to extend the lease at the time of my purchase (which the price of my flat was reflective of). Because&#160;currently both the solicitor and the landlord says they know nothing about it and that leaves me in the position of negotiating&#160;a&#160;lease extension when it looks on the record that I only have 68 years left (Marriage value etc)&#160;</p> <p>Thank you again for your efforts and explanations.&#160;</p> <p>Jennie</p>

Jennie - make a note to post again if you need to. Hopefully you have enough to keep the ball rolling&#160;<br> I can check the paper records for 'more' although I think all they will confirm is the smallest of detail and not what you actually need, which is the deed of variation (a surrender and regrant of the lease in effect)&#160;<br> Letters and so forth don't replace the legal deed itself and if that's 'lost' then you need a new one

Vicarage Court are trying to help but don't have any of their old records.<br> <br> I have been advised to request a copy of the application that you mention above - the report was submitted at the time of my purchase (the one that was returned due to errors)? Hi Jennie - if you need a copy of what we have retained and scanned from the 2014/2013 application then you can apply by post for a copy using form OC2<br> <a href="https://www.gov.uk/get-information-about-property-and-land/copies-of-deeds">Get information about property and land: Get a copy of the deeds - GOV.UK</a>&#160;<br> Copies of the form DL (list of docs submitted) dated 12th Nov 2014 and a copy of our letter of rejection dated 17th Feb 2015 are all we have on record re the application from Vicarage Court Solicitors Ltd&#160;<br> AGL300161

It shows that the new lease was never registred and that my solictors left the term length blank.&#160;<br> <br> The freehold was sold at exactly the same time which seems to also be part of the issue. So I would now like to send in an OC2 form for eveything attached to the freehold title. Hello Jennie - the register, title plan and lease itself are the available documents. Form OC1 for register/title plan and form OC2 for a copy of the lease. His lease is 125 years long from 2005 and he bought the leasehold title 2007 so his situation is 'different' to your own it seems. Is he looking for something else?&#160;EGL494946
