I owned this freehold property jointly with my late wife as Tenants on Common. I am the executor of my wifes' estate and beneficiary of her share of this property (by her Will, modified by Deed of Variation) and wish to remove the Form A restriction.

A full list of the forms (and, if possible, other documents) I need to submit to achieve this would be useful.

So far I have
 - forms RX3, ST5, ID1
 - documents (certified by a solicitor copies?) Grant of Representation and Will? and Deed of Variation?

Further, I need HMLR to expedite the change as I am seeking a mortgage on the property to gift funds to my daughter to enable her purchase of a house (which is almost ready to exchange contracts). Is the following appropriate evidence:
 - my mortgage offer
 - A statement from myself saying I plan to gift £xxx (a six figure sum) to my daughter to enable her purchase
 - the Estate Agents memorandum of sale with my daughter as buyer

Should I send the expedite request with title number first via

Is it quicker to use a solicitor?

Dhiten - I am sorry to read of your loss.
To update the register you will need forms DJP and RX3/ST5. Plus a certified or official copy of her death certificate or probate
You don't generally need form ID1 and we don't need the will/deed of variation
Please refer to PG 6 and sections 4 and 8 for guidance - Devolution on the death of a registered proprietor (PG6) - GOV.UK
You will need to submit the application first and request expedition second
It's only 'quicker' using a solicitor if you are unsure as to what's required re the forms/ST5 or are uncertain in any way. A solicitor/conveyancer will be familiar with the process, forms and more

Thank you for your answer.

I requested my application to be expedited two days after posting it, the response a further two days later was "There are no live applications on the title to expedite".

Approximately how much time is needed for the paper to be scanned and queued in your computer as "a live application"?

Obviously I dont want to wait too long!

Dhiten - you need to factor in delivery time also. Generally speaking once an application is received it's scanned into the system within 24/48 hrs

My application for title SY522134 was eventually received by HMLR after 10 days, ref T380GST, and expedited - by that time I'd sent it again - so HMLR recceived two similar (but not identical) applications.

On 28th January I received a letter dated 18th January asking for clarification on the ST5 of how the interest passed to me. I posted the response that afternoon (amended the ST5 to state "The deceased share passed to XXX by the will of YYY") by Royal Mail Tracked 48 - apparently it has still not reached HMLR 6 days later on 3rd February.

It seems Royal Mail take 10 days for each delivery.

Is there an option to email the ST5 (PDF or JPG), or do I need to pay £8 for a Royal Mail that actually delivers.

Am assuming the dellivery has failed, but its possible the tracking is at fault.

Dhiten - we have still yet to receive your reply. You can use the email address provided on the letter to respond if you wish and the casework team will consider as appropriate

For anybody else reading this I sent the document by email and the reply said "Documents to support applications are not accepted through this channel".

Royal Mail claim my letter posted 28th Jan reached HM Land Registry on 7th Feb, 10 days after posting. Confirmation of receipt and an update on how long it might take to change the title would be appreciated. The vendors of my daughters house purchase are getting extremely impatient.

I posted another copy - also on 7th February, 1st class signed for - which has not reached HMLR yet. It appears Royal Mail consistantly take 10 days to deliver, and if senders resend mail once that will double the mail HMLR receives.

Dhiten - your application, as received on 18th January, has been completed and the register updated on the 7th February. Confirmation is presumably still in the post but the registered information is available online already
