Hello.

I am currently in the early stages of a potential property purchase.

After having read through a copy of the title register for the freehold property in question, and having compared it to those from neighbouring properties, I have discovered a number of minor spelling mistakes in the Charges Register section.

1) The first entry in the charges register refers to the original conveyance, which is from over 100 years ago. There is a spelling mistake in the original vendor's name, with an extra letter appended to one of the words in the vendor's name.

2) A later entry in the charges register, listing covenants relating to the above conveyance, also has a minor spelling mistake in one of the words it contains.

Please could you tell me:

1) Do such minor spelling mistakes need fixing, and what are the potential consequences of not doing so?

2) How straightforward and quick would it be for the current vendor to have these spelling mistakes in the title register fixed, and what is the process to do this?

Hello M T - yes re 'fixing' but whether they need to be corrected prior to or after completion is really up to you/your conveyancer.

Is it correct to assume that fixing such minor spelling mistakes can generally be dealt with directly by the land registry, and wouldn't, for example, need a court order to fix? If you are able to give a rough estimate for how long it would take to amend the register, that would also be appreciated.

M T - if the supporting evidence or filed documentation supports the amendment then a court order shouldn't be needed. A court tends to come into play if there's a legal judgement needed
Amendments can wait 3-4 weeks currently but if there's an urgency then include those details in the submission and ask the support team to escalate the request to keep the timescale short
