Hi there

Im in the last bits of purchasing a property. In the last searches this was found. When i spoke to my solicitor they advised it is a unilateral notice. The sellers solicitor has advised that they will get this this removed ASAP and will speak to this 3rd party.

How long will this take to be removed if fast tracked? Has this unilateral notice been sent with any proof? Has any movement happened on this?

Hi Emma - if they are going to ask the 3rd party to withdraw/cancel their application then we need that request to come in from that 3rd party first. As soon as they provide a sufficient request we can then cancel it fairly quickly.
No such request has been submitted as yet it seems

Can the sellers solicitors in the mean time put in a un4 form? 

Also how long does the unilateral notice last for if no proof has been sent in?

Hi Emma - they can but that's the much more long-winded approach. A UN1 application stands on it's own so no 'proof' is required other than the form.
Once processed the registered owner is then notified. If they decide it's not valid they can submit a UN4 as you mention

HI Emma - none re the UN but we have now received an application to discharge the existing legal charge (mortgage)

We was told the sellers solicitor has put in the un4 form 5 weeks ago but haven't heard anything can you tell me what is happening?

Hi Emma - the original application as lodged by GHP LEGAL to register a Unilateral Notice is still pending as we are awaiting a response from them to our request dated 10th September. Until they respond we can't complete later lodged applications.

To confirm that the un4 from the sellers solicitors hasn't been processed yet.

Emma - if they don;t reply then it can be cancelled but that's some way from happening at present and we would generally issue a reminder before we do that.
The UN4 won't be processed until the prior pending application(s) have been dealt with. There's also an application to discharge the registered legal charge (mortgage) to be processed as well
I'll check with the casework team to see if they are able to progress matters re those other pending applications even though neither can actually be completed until the UN1 is dealt with

So what is the time frame for the un1 to be cancelled if no reply?

Emma - once a request is issued they are usually issued a reminder after 6/7 weeks . Cancellation may follow thereafter if they fail to respond

Hi Emma - just to update you that the casework team have written to the conveyancer to advise that they have until the 8th November to respond 
We must give them notice and time to respond. Clearly what happens next will depend on their response
