Transfer to seller pending registration (Title Number BK201847)

Hi,

I am purchasing a leasehold retirement property as a cash buyer - offer was accepted in August 2024, but the purchase is stuck with land registry. I am currently in rented accommodation however and the longer this sale takes, the more it puts the sale at risk due to depleting funds.

Address: 27 Willow Court, Reading Road, Wokingham, Berkshire, RG41 1EG

My conveyancer sent an enquiry to the sellers as "the transfer to the seller dated 01/07/2024 is pending registration." Until such time that the transfer to the seller has been completed, my conveyancers have advised that we cannot proceed until the transfer to the seller has been completed. Just to confirm - is it definitely the case that I need to wait for transfer to seller before proceeding with my own sale?

As of 4th February 2025, I understand that the application has been expedited. However, I have also been told by the seller's solicitors that "the seller's registration is currently behind other pending applications for registration of flat leases. If you insist on waiting until our application has been completed, you may be waiting for up to 1 year. The only other option would be for you to contact the solicitors for the pending applications in front of our clients and ask them to expedite their applications".

I want to check if there are any updates on status, timelines and whether the seller's registration has indeed been expedited, but is stuck behind other applications?

Hi Chi Wong - the timing of your completion will be a matter for you and your conveyancer.
The information the conveyancer has provided is correct 
The expedition of the later applications should though hasten the prior ones refererd to and I'll flag with the casework team to see if that can be done

Thank you for the quick response Adam and for flagging to the casework team - anything that can be done to expedite this would be very much appreciated.

Would you be able to confirm how many applications are ahead of the one made by the seller, what they are pertaining to and why they are stuck?

Chi - nothing is 'stuck' but simply waiting to be processed. There's just the one prior application with regards a new lease for a different property and that needs to be processed first. Then there are two separate applications to register the Transfer you are waiting on. They affect a variety of titles and involve a portfolio of properties
Suggest you make a note to post again next week and we can check again for an update

Hi Chi - the prior application re a new lease for Flat 16 has been partially processed but we need more from the conveyancer. They were contacted on 6th May
They are aware of the urgency but we are very reliant on the conveyancer to respond before your own/later applications can be processed

Sorry to chase again - I’ve unfortunately been given 2 months notice to move out of my current rented accommodation as the owners want to move back in. The only thing outstanding on the sale is with regards to this transfer to seller pending registration - is there any way to please expedite matters further or proceed without this?

Hi Chi - the new lease for Flat 16 was completed today. That should help progress the later applications and I'll flag with the casework team to get an update for you

Thanks Adam, I appreciate that. As you can imagine, this is causing an extreme amount of uncertainty and stress as I am unable to find any short-term lets in the area, all rentals are for 1 year or more, so I need to complete in the next 2 months. Do you know how many more applications are ahead of mine and roughly how long this should take?

Chi - the next application in line is the Transfer to Churchill Estates. That is then followed by a new lease re Flat 6
I believe you are waiting for that Transfer to be registered

Thanks - just to confirm, am I just waiting for the Transfer to Churchill Estates (the sellers) then, which is next in line? Once that is completed, then my sale should be able to go through thereafter? Or am I waiting for something else after the new lease for Flat 6?

Chi - there's nothing waiting after Flat 6 but that application presumably has no impact on you re delay. I'd suggest speaking to your legal rep to confirm
