Hi,

When we purchased our property in 2019 a restriction was added to our properties title deeds. This restriction was not there when the previous owners were on the deed, I have checked and it is added on the TR1 that was completed. We did not specifically ask for this and whilst our 1st remortgage provider did enforce the restriction but the most recent one did costing us a few £400.

The restriction is as follows "no disposition of the registered estate by the proprietor of the registered estate is to be registered without a certificate signed by a conveyancer that the convayencor is satisfied that the person who executed the document submitted for registration as disponor is the same person as the proprietor"

My question is how do we remove this restriction before our next remortgage?

Hi - that's a form LL restriction applied for with regards helping to prevent property fraud. A few conveyancers apply for it as part of their service offering to clients. It's aimed at absent owners/landlords really but some feel the need to apply.
To remove it you need form RX3 plus the certificate as per the restriction wording. So you'll need a conveyancer to check your identity and certify that fact

Thank you for the helpful response. One quick question if I may?

In section 8 of the RX3 form it asks for a box to be checked. "the application relates to

- the registered estate
- the part(s) of the registered estate as shown:
- the registered charge dates (blank) in favour of (blank)

Please can you confirm which box i should check?
