Hello,

I am currently in the process of buying a property (my parents are the sellers) with an old Equitable Charge on it from 2002. The company that originally owned the debt became insolvent years ago but after a lot of searching we managed to track down current holders of the charge and they have applied to have it removed.
However when I tried to contact Uxbridge County Court with regards to its progress they have yet to respond to my enquiries after a week so I am wondering if I am contacting the wrong people with regards to this charge removal or if it is even in progress at all. Any help with this would be appreciated as it is the last outstanding charge that is delaying the sale and we're at our wits end trying to resolve this.
If it helps it is in relation to Title Deed: DU177430.

Hello Connor - they wouldn't usually be applying to the court as they need to 'remove' it from the land register as that's where it has been protected and which would need removal before you could complete. The court/debt is the seller's to deal with IF the court needs to be involved.
We do have an application against that title so if there's an urgency then a request to expedite should be made - Request an expedite - GOV.UK

Thank you for your swift reply Adam, this has been a stressful process so its good to hear progress is being made. I have submitted a request to expedite using the information you provided so hopefully this will be resolved soon, is there any time frame on how long the removal request will take if this request to expedite is denied?

Connor - it shouldn't be denied if you are a confirmed buyer. But as you've asked then it would likely wait several months before being processed.
The key now is that it is all in order and we are able to process it quickly and without the need for more from the applicant or wider checks.
Suggest you post again on Friday and we can take another look to see if processing has started

Hello again,

I am updating this to see if there has been any progress on the processing of the requested removal.
I received an email from the Land Registry two weeks ago saying my request to expedite had been accepted but I have heard nothing more since.

Hello Connor - partially processed but we need more from the conveyancer. They were contacted on 18th Feb and we await their response. You'll need to contact them to confirm/clarify

Okay good to hear it's getting somewhere though I am confused which conveyancer is involved, would this be mine as the buyer, the sellers or the company that submitted the request?

Connor - it wouldn't be your conveyancer as you are the buyer and you want the register updated before you can complete.
The conveyancer who acts for the creditor is the one who has applied - I'd suggest having a chat with your own conveyancer to clarify/confirm

Hello again,

I have tried contacting both my own conveyancer as well as the company that began the proceedure to remove the charge but neither can provide me any information on the status of this process. Has there been any further progress on the processing of this request? We're starting to get a little worried now as this continues to drag on, is there any time scale we can expect this to hopefully be resolved within?

Hello Connor - we are still waiting for a reply to our request dated 18th February. Until they respond we can't complete the application and update the register, They will get a reminder in the next few weeks but the ball is very much in their court
I'll issue an early reminder to see if that prompts them to respond sooner

Hello - Has there been any response from the company in regards to the request dated 18th February? We're really starting to get desperate here and we need to know if there is anything happening or if we can do anything to help with this.

Hello Connor - they did respond on 20th but it was insufficient and we went back to them on the 24th and are awaiting their response
