Hi Rebecca - what's legal or otherwise is not for us to advise or comment on here. That would be a matter for your conveyancer, the developer and Homes E to consider. Provided we get the consent then it's sufficient to register 
Again, whether it should have been picked up is only a Q your conveyancer can answer with regards what checks they made and/or are required to make and at what point they consider exchange and completion can then take place.
Homes E said they would keep me informed re progress at their end but I suspect that will be very similar to how you are also kept informed, namely only when it has been completed for example.

Hi Adam

I hope you’re well and I am so sorry to trouble you again!! I was just wondering if you were able to answer this for me.. apparently there is an error on the land registry - The freehold title does not list the leasehold title which it should? Is there anyway I can get this amended in order to respond to final enquiries as my sale is still pending.

Hi Rebecca - it's not an 'error'but a natural consequence of how the registration process works and how buyers/lenders then check and view registered information when a new sale/purchase/mortgage is involved.
The registration of a new lease purchase is essentially the creation of a brand new leasehold title and an update to the existing landlord's register. As each new lease is registered they get their own new title and the landlord's register is added to in sequence, namely the order in which each new lease application is applied for.
So in basic terms the landlord's title re your property is BL160238
The current 'pending' order of applications in order of priority is Plot 229, 235, 233, 231 (your lease) and a couple more.
When we expedite a new lease registration we can, as in your case create the new title out of priority sequence. However we can't do that on the landlord's title so each new lease is then added in the priority order as applied for.
So in this case plots 229 and 233 have yet to be completed as we are waiting for the conveyancer to submit requested information. 
Plot 235 is like yours completed as far as the new lease is concerned but like yours cannot be added to the landlord's title until 229 has been completed. Your lease can't be added until 229, 235 and 233 have been added. 
Historically this was never an issue as a buyer/lender focus was on the leasehold and new title only. That has changed over time and all I can suggest is that you speak to your own conveyancer to clarify but to also respond to the outstanding requests re the still unprocessed new leases as mentioned

Land registry needs reform urgently. It would be an essay to go through everything but they are the only systems to use cheques and passport photos I know. They have not kept up with the digital age. I think it's time to also move to the Scottish system as you can make an offer and get the keys to a property in less than two weeks, this is common. I have sent my complaint to the ombudsman and I suggest others do the same. It has made me quite ill dealing with the system although other parts of the government/council have also played a part.
