I am wondering about the status of a recent application by the developers to amend the boundary on the title plan of a property that I’m in the process of buying. I believe it was expedited but would like to know if it was, when it was submitted and what the current status is, please.

Hi - that post code only reveals 3 postal numbers in Culworth Road. There's no obvious development nearby so do you kinow the title number perhaps?

Can you try OX17 1FL instead please. That might identify it. It’s plot 1 of 8 recently built houses backing onto the village sports field .

Biginefl - that's a better match although there are only 4 pending applications against the title and each are for new plot transfers. None are of Plot 1 and there's no separate application to amend the boundary.
I'd suggest contacting the seller to ask them to confirm what's actually happening

Hi Adam

It would be a new plot transfer as I’m buying that property. Perhaps it isn’t an amendment as I said initially if it’s not been registered before. However, I know the developers have amended the original development plan boundaries. So it must be one of the 4 pending plot transfers you mentioned.
I’ve attached the original development plan showing the 8 new build properties in the development and I’m buying plot 1, which is the property at the bottom on the plan with the largest garden and the first one you come to as you drive into the development. 
Do you have any info on the status of that plot transfer please?

Have just found the title no NN384073 relating to the planned development on the LR website and dated 6 Nov 2024. Are there any pending applications submitted after 6 Nov?

My solicitor has just looked on the land registry portal today and says she can see there’s an application processing for NN384073 but can’t access the full details. Are you able to please?

Hi Janet  - There are no new applications since 6 November. We currently have applications affecting Plots 2, 3, 4, 5, and 7. There is nothing currently pending against plot 1

Thanks Darren. In that case, if there is no new application after 6 Nov for Plot 1, I’m assuming that one possibility might be that the Land Registry has raised enquiries about the application and that is why it is still showing as processing?

Biginefl - just to be clear there is no pending application specific to Plot 1. The only pending applications affect Plots 2-5 inc and 7.

Thank you. The only reason I keep pursuing this is that the developer of plot 1 has repeatedly told me that they are awaiting a response from LR. As recently as last Thursday she emailed this “Further enquiries came back off the plans submitted on 6th November. I am still waiting for a response from Land Registry.” So it’s difficult to know why there is a hold up in their solicitors issuing a plan with the Transfer Deeds to mine and neither they nor their solicitors are responsive to any further questions.

Hi Biginefl - there was an 'enquiry' dated 4th Nov re plots 1 and 7 but we replied to that on the 6th November. So nothing outstanding against the title that relates to Plot 1 specifically

I have since found out that following the receipt of the letter mentioned above from LR on 6 Nov, the developer’s solicitor submitted an amendment, which has been rejected. I believe the developer may then have submitted another amendment. Please can you confirm if this is the case?  If so, what is the current status?

Hi Janet - no 'amendment' submitted although there has bene some correspondence from the developer re a change to the estate plan previously approved. I suspect, but have no way of knowing, that may well be the amendment you are referring to and which in turn may help pave the way for an application to register Plot 1 for example.
