Title Deed / Restriction Removal

Good afternoon, 

I hope you might be able to help. 

We have hit a brick wall in our purchase of 30 Driver Way, NN8 1TA. 

We are obtaining a lifetime mortgage and the lenders solicitor is insistent on have the title deed updated to remove a restriction at B:3 to the title that refers to an interim Service Deed dated 19^th December 2019. The plot is being released from the interim service charge regime and transferred to a new service deed, the Land Trusts regime.

Apparently once this is all done, the lender will be satisfied and we can exchange. 

The whole transaction has been going on for months and we risk collapse of the chain if this is not resolved this month. 

Can you see if this has been lodged by the sellers solicitor and how long it will take to resolve?

Thank you Adam for the superfast reply  - once the sellers solicitor submits, do you know what current turnaround times are? 

Terry - wait times are lengthy so they need to submit first and request expedition second. Two separate things to ensure that it's processed asap - Request an expedite - GOV.UK
Everything then hinges on it being in order of course

Hi Adam, I wondered if the situation had changed on this yet? Did you receive the paperwork from the sellers solicitor, Arnold Thompson? Any updates would be greatly appreciated.

Thanks Adam - it's very strange as the sellers solicitor has confirmed that the details were sent to land registry on Thursday last week (13/03/25). Would there be any reason why you wouldn't be able to see this yet? I am just waiting on confirmation that they have requested to expedite the case. Thank you for your assistance. 

Terry - if they've submitted an application then they should be able to confirm our reference and title number for you. Nothing showing as being received at our end

Hi Adam, the solicitor has confirmed the application has been submitted and the expedite request will be made - refernece number X683CVT. Anything you can do to speed this up would be amazing. Thank you.
