I believe my title deeds do not have a title plan. I have a copy of the title deed but there is no plan with it. Unless my solicitor didn’t send it to me. It’s now a problem as I need to know which garden fence I am responsible for and I am assuming that would haven been on the title plan marked with a T I believe. If the title plan doesn’t exist can you advise what I can do. My neighbour has put a fence up but I believe it’s in the wrong place and I now have a foot with extra garden. They rent the property which is a problem in its self.

Hi Gillian - If your property is registered with HM Land Registry then there has to be a title register and title plan. 

Often when there is a change of ownership or something else then the title register will be updated but the title plan remains the same, and hence the solicitors may not include it in the documents. 

Can you tell me if the property is registered with us, and if so, give me the title number so that I can look further into it?

I would add that majority of the title plans prepared by HM Land Registry will not show any boundary responsibilities or T-marks.  Please see our blog, Drawing the line on boundaries, on how to find information if it is held by us.

Hi, thanks for replying, the title number is TY463150. If you could check that would be great, I always thought there was some kind of reference to who was responsible. I have all the original documents from 1903 and I can’t find anything. Many thanks

Hi Gillian - Thank you. 

Firstly, I can confirm that there is a title register and a title plan for the title TY463150.  If you wish to obtain a copy then please refer to the guidance on our website - Get information about property and land: Overview - GOV.UK

I have also examined the title register and all the other information we hold on the title.  There is no information about boundary fence responsibilities.  I have also checked the adjoining titles, and again there is no information about any boundary responsibilities.

Thank you for checking for me. I will obtain a copy of the plan for my records, I shall sort out the problem of the fence being erected in the wrong place. Thanks for checking for me
