Good evening.

I am in the process of purchasing a property and was advised by my conveyancer that the only remaining issue is the removal of a title restriction relating to the management company (Title number BM361240).

There has been some disagreement between both solicitors on who is responsible for making that request to HMLR. Could you please advise on whether it is the seller's solicitor who should be submitting the request (and what is the process that should be followed) or if it is rather the responsibility of my solicitor?

I would appreciate any help with this.

Cris - very much a matter for them to discuss/agree upon. Anyone can apply but the timing of an application to cancel or withdraw a restriction is down to the conveyancers involved in the sale/purchase
I guess if your conveyancer won't complete and apply then the ball is in the seller's court as to whether they apply and then complete on the sale
