Hi. We are currently in the process of purchasing a property, and our solicitor has identified two incorrect restrictions recorded in the property’s Title Register. I was informed that the seller’s solicitor had applied for the removal of both restrictions. However, I was subsequently notified that while the standard restriction had been removed, an incorrect restriction had been left in its place. The seller’s solicitor has since submitted an application to have the incorrect restriction removed and the correct restriction reinstated. It has now been five months, and we are still experiencing delays regarding these restrictions. We have not received any updates for some time. We are not sure whether they had requested an expedite on this application. Could you kindly advise on the current status of the matter? Hi Frankie - they submitted an application on 1st Dec and it's waiting to be processed. It's not been expedited as yet as they requested that as part of their submission. As such it would not have been seen until processing started. We ask conveyancers to request expedition through a dedicated channel.
I'll flag it now with the casework team as your post has prompted me to check what was submitted on the 1st Dec
Expedition gets the case to the processing start line quickly. It does not guarantee that the case is then completed immediately as removal and entry of restrictions often require consideration by a senior technician and/or checks with the restrictioner. I would suggest you make a note to check again next week and we can see if there is a new update to share
