<p data-end=701 data-start=281>I am in the process of selling my property, which consists of two titles (as additional land was later incorporated by previous owners). The register for the property records a historical Right of Way entry dating back to 1965. However, this Right of Way no longer physically exists. Over the years, the land has been altered, and the area where the Right of Way once ran has now become part of my garden within my boundary.</p> <p data-end=978 data-start=703>The buyer’s solicitor is insisting that this Right of Way be formally removed from the deed. Unfortunately, this seems impractical, as the Right of Way dates back nearly 60 years and it is impossible to identify or contact the original parties who may have held that right.</p> <p data-end=1007 data-start=980>Could you please clarify:</p> <ol data-end=1266 data-start=1008> <li data-end=1120 data-start=1008> <p data-end=1120 data-start=1011>Will this obsolete Right of Way be automatically removed from the register upon amalgamation of the titles?</p> </li> <li data-end=1266 data-start=1121> <p data-end=1266 data-start=1124>If not, what is the most efficient way to address or resolve this matter, given that the buyer’s lawyers are being inflexible on this point?</p> </li> </ol> <p data-end=1313 data-start=1268>Your guidance would be greatly appreciated.</p>

Mikes - rights can be removed as a result of amalgamation if it is clear that the land over which the right exists is being amalgamated with the benefiting title<br> The alternative is to apply to remove the right based on the 'abandonment' for example -&#160;<a href="https://www.gov.uk/government/publications/easements">Easements (PG62) - GOV.UK</a>&#160;<br> Very much a Q to get legal advice/assistance on<br> Land registration is complex, designed to protect legal and financial interests in property. <p data-end=541 data-start=531>Hi Adam - Thanks so much for your reply. I’ve now submitted Form AP1 and included a letter explaining the request to amalgamate, showing clearly that the land over which the historic right exists is being combined with the benefiting title. I can share the HMLR reference with you privately if that’s helpful for your awareness. Let me know.</p>
