Why is Form A restriction there?

Hi, my parents would have owned their property as joint tenants.  My father passed away in 2021 and the DPS form completed to show my mother as sole owner.  <br> when I review the title there is a form A restriction, but I can’t see why it’s there.<br> Please could you explain.  The title reference is HP222819.<br> thanks

Hi Helen - the form A/joint ownership restriction is there as when they bought the property in 2008 they declared in the form TR1 that they were tenants in common in equal shares<br> You can apply by post for a copy of the Transfer dated 20th June 2008 to confirm should you wish to - <a href="https://www.gov.uk/get-information-about-property-and-land/copies-of-deeds">Get information about property and land: Get a copy of the deeds - GOV.UK</a> <br> And, if your Mother is now the sole legal and beneficial owner, apply to cancel the form A restriction - see section 8 of our PG 6 for guidance re forms RX3/ST5 and how to apply as appropriate - <a href="https://www.gov.uk/government/publications/devolution-on-the-death-of-a-registered-proprietor">Devolution on the death of a registered proprietor (PG6) - GOV.UK</a> <br> I should stress that even if you think there was an error in completing the form TR1 back in 2008 we would still now require a formal application to cancel the restriction.

Thanks, I’ve now seen the transfer form and to my surprise they did apply as tenants in common, so it now makes sense.  I’ll start the process to have it removed.  Thanks for your help.
