I refer to Title CB215181 and your ref J5858GFV. I have been in contact with the solicitors who registered a restriction on my property in 2018 following a dispute with my tennant, named as W*****S and son. These solicitors have confirmed to my conveyancer that will state they have no interest in the property on completion as the case was resolved satisfactorily in 2018. The solicitors have stated that they have no other paperwork on the dispute but have confirmed in writing that it was a negotiated settlement and that settlement has been received and completed. They asked for £x and received £x in the time scale they requested. My buyers solicitors want the restriction removed prior to sale ie: now. I have sent the confirmation letters from the solicitors yesterday and attach them again below. This is very, very urgent and I may lose the sale if the title isn't updated ASAP. Thanks for your help.

Simon - I can see that your second application/paperwork was received yesterday and that's been referred to the casework team to review/action as appropriate. They will do that asap as the first application is already expedited CB215181

Simon - as the second application has been lodged by a conveyancer your first one is no longer required. In the circumstances I would recommend that you withdraw the first application (J585GFV) using our contact form. Adam whichever is the quicker way to do it - as long as you have the up to dat paperwork from the solicitor in question

I have submitted this just now via the contact page - Ref J585GFV - I believe that my conveyancer has submitted the same paperwork yesterday [attached again] - if the quickest way to resolve this VERY urgent situation is via my conveyancer please remove my application - if it isn't please leave in place - I just need this resolving ASAP - please advise

Simon - you need to make such a request through the contact form, not this forum. If you want to add caveats to your request to withdraw then please reply to the acknowledgement received to add.

I've withdrawn J585GFV in favour of my solicitor via the contact form - and made a note there noting to withdraw if it provides a quicker solution - as I don't want to go backwards - can you confirm that this has been actioned please, thanks

Simon - I can see you've submitted a request and that's been referred to the casework team to consider/action as appropriate. I note you also contacted us through the contact form on 23rd (twice) and 24th as well sand those too have been referred to the casework team CB215181

i have withdrawn my application in favour of my conveyancers E RX3 application - I just need this resolved ASAP else the sale will fall through - it was sold in September and this has been desperately slow - I was trying to deal with Leedsday on your instructions who eventually told me to never contact them again .... after telling me they have no other records for this dispute [in the letters i have submitted] and the original litigant has left the country and is uncontactable.

I have just received a letter via email that states: Your application has now progressed and notice has been served on the restrictioners. The notice has a 15 business day expiry and expires on 19 March 2026. Is there anyway that Karen Jones [6400] can call Email or fax LeedsDay to speed the process up - LeedsDay have already confirmed in writing [you have a copy] that they have no interest in the property and this is simply more delay as I'm sure that LeedsDay will not respond and that will be another two weeks!

Simon - no, the registration process requires us to serve notice as per the register information. If you wish to hasten that process you will need to contact them direct to ask them to respond. Our hands are tied with regards how we deal with such applications (RX3) and then any wider checks (notices) in such cases and we have done all that we can to expedite/hasten the process

You have letters from them and a Statement of Truth from myself - I cannot understand why in this modern day you cannot fax, email or call them to confirm. You have the name of the lawyer who signed the document. I also asked for this process to be started weeks ago and you are sending a letter today. I'm sure that leedsDay are registered in the LR system, can you not send them a message through that system, it's 2026...

Simon - the registration rules and requirements are quite clear with regards how such checks must be carried out. They are required to respond to the actual specific checks when received and not through some other channel. I would recommend speaking to your conveyancer/the buyers conveyancer to explore how the form K restrictions on the register are all being dealt with prior to completion and why this specific one is a barrier bearing in mind the current circumstances and our PG 76 section 4 guidance - <a href="https://www.gov.uk/government/publications/charging-orders">Charging orders (PG76) - GOV.UK</a>

I have emailed LeedsDay just now. Also the restrictioner [Wagner and Wagner] are no longer in the country having left circa 2020 as they were visiting US Forces - I have attempted to contact them on the email address I hold for them but received no response. Can you let me know the question/wording that you will be asking LeedsDay so I can manage my expectations, thanks

Simon - many thanks and all noted and appreciated<br> My Qs are aimed at trying to help you find a way forward here and not trying to cause additional issues or concerns<br> So you have notified Wagner/Wagner of the sale and the buyers conveyancer have accepted that but won't follow suit re the LeedsDay restriction?<br> What about the third form K restriction with Arval Limited?<br> Re LeedsDay we will be asking them to consent/object to cancellation of the restriction.

Arval will be settled upon completion. I have notified by email Wagner and Wagner [twice in December 25] and haven't received a response, LeedsDay know I have emailed the Wagners but will not remove the restriction without their consent hence the need for the RX3. There are not two restrictions from LeedsDay relating to Wagners? I believe there was a change of their address which is why its mentioned twice? The buyers solicitors are only concerned with the Wagner restriction, even though LeedsDay have told my solicitor on the day of completion they will respond to their enquiry as "They have no interest in the property", this is not good enough for the buyers solicitor. LeedsDay have also infomed the buyers solicitor that this is not normally how this is dealt with - but they refuse to exchange contracts until this is removed - the time-line given by my buyer to exchange contracts [he bought the property in September 2025] is the 28th Feb else he will pull out, this was the reason my original request at the beginning of the month was expedited and the fact I am now renting another property and continue to pay the mortgage on this property which, as I'm sure you will understand, is causing financial distress.

Simon - many thanks. Just wanted to be certain as to what you had been advised and what the buyers conveyancer was insisting upon. From a purely registration perspective the form K restrictions can be overreached on a sale as explained in PG 76. Provided each restriction is complied with, namely the named creditor is informed as stated, then they would be automatically cancelled on registration of the buyer. Similarly if an application is made to cancel a restriction we are obliged to follow a strict set of rules/requirements that protect all parties, including ourselves.<br> The fact that it is now 2026 makes no difference sadly as modern times don't always negate the checks and more needed to confirm everything is ok re cancellation of the restriction<br> As things stand you are left with two options and both we have covered - the wider checks now underway are with the two Wagners as named in the restriction. And as you are aware the postal addresses for each are the Leeds Day address on the register.<br> They have until after 19th March to respond but as you have explained that is probably unlikely in the circumstances and time will run out after that date. If it does, and no response, the restrictions will be cancelled<br> The second option is to convince the buyers conveyancer that cancellation is not necessary prior to completion providing the restrictions have each been complied with.<br> That applies to all three current form K restrictions from a registration perspective of whether an agreement has been reached regarding settlement after the purchase monies have been received

I understand that the checks need to be completed, I was just questioning the method of delivery. I have received correspondence direct from the Registry via email, is this how it will delivered to LeedsDay? I have given LD notice that the request is on its way to them, thanks

Simon - No as mentioned the checks are completed as per the information held on the actual register itself.<br> Parties provide their contact details as shown on the register and we are required to rely on and use that information to complete such checks. The checks are therefore issued by post<br> Please don;t attach items of a personal nature to the forum thread/posts. Thanks, can you tell me when they will receive your letter? They will have access to yourselves through their business portal so can they respond to you through that? I did ask the LR previously [about a month ago] why on the submission of my evidence why can't you write to Leeds Day, it's just taken so long to get to this stage. I've spoken to the Buyers solicitor and they REFUSE to exchange contracts until the restriction is removed! Even after seeing Leeds Day letters saying the dispute is settled fully and finally they wonder "What if Wagners come back" I've told them a licensed law firm has stated that it's finished - why would they risk their licence? Ive also showing them your response and that of other conveyancers - If Leeds day don't respond how quickly will the restriction be removed? And if they do respond ??
